This agreement is made between PULAT TRADING LTD. (CRATOS HOTEL) located at Beşparmak Street No:8 Çatalköy GİRNE, with contact number +90 392 444 4242 (referred to as CRATOS HOTEL in the agreement), and the individual (referred to as the CONSUMER in the agreement) who has registered on the website www.cratospremium.com.tr and completed the online reservation process; based on the address, identification, and contact information provided by the consumer during registration.
The consumer who purchases accommodation through our website is responsible for paying the full amount of the service fee at the time of reservation. The reservation is not confirmed until the full payment is made.
In the event of a price increase in the contract fee, the difference will not be requested from the consumer, and the discounts referred to as "actions" by CRATOS HOTEL will not be refunded to the consumer.
The consumer can cancel their accommodation by notifying in writing up to 1 day before the start date of the accommodation, except in cases where the consumer is unable to attend the purchased accommodation due to force majeure. If the consumer has purchased travel insurance, cancellation is possible. If the consumer does not have a visa or is unable to obtain it by the start date of the accommodation, CRATOS HOTEL does not accept any responsibility and will collect the accommodation fee.
CRATOS HOTEL may partially/fully modify or cancel the reservation before or during the provision of the service due to reasons not caused by the consumer. The consumer can either accept these changes or accept an alternative service offered by CRATOS HOTEL. If the consumer does not accept the changes, they have the right to cancel the reservation and receive a full refund of the fee paid under the contract. Despite taking all necessary care, if the service is canceled or postponed due to strikes, terrorism, war possibilities, declaration of a pandemic, unforeseeable technical issues, and all similar force majeure events, CRATOS HOTEL can cancel or postpone the reservation. If the consumer requests a cancellation at least 15 days before the check-in date, the cancellation will be free of charge, but for reservations not canceled in a timely manner (excluding reservations with travel insurance), a fee equivalent to 2 nights' room rate will be charged. The consumer acknowledges, accepts, and undertakes that in non-refundable reservations, the fee will not be canceled, and if the consumer requests a cancellation, it will not be valid, name changes cannot be made, and the room rate will be paid to CRATOS HOTEL. In the case of a consumer's request for a change in the service, if the request is made within 7 days prior to the start of the accommodation, and if there is a price difference between the previously booked service and the new requested service, the consumer can pay the difference and make the change with the approval of CRATOS HOTEL. For change requests made in a shorter period (excluding reservations with travel insurance), a fee equivalent to 2 nights' room rate will be charged if CRATOS HOTEL does not approve the change. However, if the price of the new service is lower than the previous service, CRATOS HOTEL will refund the difference to the consumer. Name changes cannot be made for reservations. If the consumer or their immediate family members have any health issues preventing their regular activities during the 10-day period corresponding to the accommodation period, the consumer can request the cancellation of the reservation by providing an official report from a Full-Fledged State Hospital or, in the case of death, providing documentation. In this case, the amount paid by the consumer will be refunded, excluding mandatory taxes, fees, and other legally binding expenses paid to third parties and documented, which cannot be refunded. In this case, the report and documents must be submitted before the start of the service. If the consumer fails to inform in writing that they will participate in the missed accommodation service corresponding to their booking period, CRATOS HOTEL has the right to cancel all reservations and services made on behalf of the consumer 24 hours later. No refunds will be made in such cancellations.
CRATOS HOTEL and the consumer shall fulfill their obligations arising from this agreement.
CRATOS HOTEL is responsible for providing the consumer with the Preliminary Information Form/Voucher/Mail containing the characteristics of the service, sales price, payment method, and performance-related information, as specified in Article 8 of the contract. CRATOS HOTEL is not responsible for situations arising from consumer-related circumstances or personal responsibilities of third parties.
Consumers who make a purchase with a credit card should inform the bank to which the card belongs for early payment or reduction of installments and make the payments at the designated payment branches of the bank. If consumers cancel a service paid with a credit card in installments for any reason, CRATOS HOTEL will refund the amount received from the credit card back to the consumer's credit card. The refund process will be carried out according to the rules of the banks. In the case of refunds for payments made in installments, the rules of the bank will apply. If the payment made in installments is refunded in installments to the card, CRATOS HOTEL has no obligations or intervention. CRATOS HOTEL accepts VISA, AMEX, and MASTERCARD credit cards for payment and reserves the right to temporarily withdraw a certain amount before arrival.
CRATOS HOTEL may communicate all relevant information to the consumer in writing, either in person or through a permanent data provider (email, text message, disk, CD/DVD, memory card, and any similar means or medium). The consumer is obligated to notify CRATOS HOTEL of any failure or inadequate performance of the contract, within 30 days from the date when the service should have been performed or was performed. Notifications made after this period will be deemed invalid. The consumer acknowledges and declares that they have given permission for their email, mobile phone, fax, and other contact information provided during the reservation process to be used by CRATOS HOTEL employees and/or their websites for campaign announcements.
All disputes arising from this agreement shall be resolved by the GİRNE Enforcement Offices and Courts, Consumer Arbitration Boards, and other authorized organizations in accordance with the applicable law. If any provision or provisions of this agreement are invalidated for any reason, the remaining provisions shall remain valid and unaffected. This agreement has been prepared in accordance with the provisions of the Law on the Protection of the Consumer No. 6502, and in matters not covered by this agreement, the provisions of Law No. 6502 and relevant regulations shall apply.
